Minutes
The meeting was called to order at 7:01 p.m. by Chairman Roger L. Putnam, Jr. Selectmen present included Michael May, Dale Donovan, Michael Parlante and Jerry Houk. Town Administrator Tim Smith also attended.
Selectman Donovan announced that the Wellfleet Community Forum will be presenting a program regarding Route 6 motor vehicle crashes on Thursday, May 23rd at 7:00 p.m. in the Library.
Open Session:
Candace Perry addressed the Board regarding the proposed regional waste disposal facility Chairman Putnam updated Ms. Perry on the status of the project.
Brent Harold addressed the Board regarding siting of the proposed regional waste disposal facility and brush cutting along Old Long Pond Road. Assistant DPW Director Kevin Cahoon explained the DPW s responsibilities for Town road maintenance per Massachusetts General Law. Chairman Putnam suggested that Selectman Parlante, as Chairman of the Park Commissioners, set up a committee to recommend a policy on sand roads and to report back to the Board. Chairman Putnam announced that the public hearing scheduled for 7:20 p.m. regarding the application from Joseph Lema and Son for transfer of its annual, beer and wine package goods store license and its seasonal all alcohol package goods store license to Outermost Chowhounds was postponed indefinitely because both parties
had withdrawn their applications. There was consensus to turn the sand road matter over to the Chairman of the Park Commissioners for recommendation.
On a motion by Parlante, seconded by May, the Board voted unanimously to approve the minutes of April 8, 2002 as printed.
On a motion by May, seconded by Donovan, the Board voted 3-0-2, with Putnam and Houk abstaining (they had not attended the meeting), to approve the minutes of April 16, 2002, as printed.
On a motion by May, seconded by Parlante, the Board voted unanimously to approve the minutes of April 22, 2002 as printed.
On a motion by Parlante, seconded by Donovan, the Board voted unanimously to approve the minutes of May 6, 2002 as printed.
On a motion by Parlante, seconded by Donovan, the Board voted unanimously to release the executive session minutes dated 9/11/00, 9/18/00, 9/22/00, 9/23/00, 9/25/00, 9/28/00, 9/30/00, 10/13/00, 10/16/00, 10/20/00.
The Town Administrator announced that on May 15th Senator O Leary will be meeting with Town Administrators and members of Boards of Selectmen at the Orleans Elementary School to discuss the State budget.

Selectman Donovan presented his correspondence report.
The Board held the following Shellfish Department public hearings consecutively. Selectman Donovan read the public notice. Selectman Parlante disclosed that he holds a commercial shellfish permit, has a shellfish grant license and owns waterfront property. Selectman May disclosed that he holds a commercial shellfish permit. Chairman Putnam disclosed that he holds a senior commercial shellfish permit. Shellfish Constable Bill Walton was in attendance and presented his recommendations.
Application received from Myron, Judy, Rebecca and Anna Taylor for a .937 acre extension of shellfish grant license #734 located at Mayo Beach the Shellfish Constable recommended that this application as designated on the map drawn by Slade Associates be granted. On a motion by Houk, seconded by May, the Board voted unanimously to approve the recommendation of the Shellfish Constable.
Application from Ronald Buck for a one acre extension of shellfish grant license #2000-7 Selectman Parlante recused himself and left the table. The Shellfish Constable recommended that this application be denied without prejudice pending acceptance of a Town Shellfish Management Plan noting his concerns about possible land ownership issues and that this extension would spread aquaculture into an undeveloped area. Ron Buck was in attendance and explained that he needed this extension to pursue aquaculture as a full-time occupation and noted that when he applied for his initial grant, the previous Shellfish Constable had indicated that an application for an extension would be looked upon favorably. On a motion by May, seconded by Putnam, to follow the
recommendation of the Shellfish Constable to deny this application without prejudice, the Board voted 2-2, with Houk and Donovan voting against. The motion failed. On a motion by Houk, seconded by Donovan, to grant this extension, the Board voted 2-2, with Putnam and May voting against. The motion failed. Selectman Parlante rejoined the Board.
Recommendation of the Shellfish Constable to amend Section V (Open and Closed Areas Chipman s Cove) of the Temporary Shellfish Regulations re: Placement of Oyster Spat Collectors in Chipman s Cove the Shellfish Constable recommended that an approximate 300 by 300 area of Chipman s Cove be designated open for the deployment of oyster spat collectors by Wellfleet shellfish grant license holders, with proper permits from the State, from May 15, 2002 through October 20, 2002 (any collectors left in the area after the closing date will be considered aquaculture gear in a non-permitted area) on a motion by Donovan, seconded by May, the Board voted unanimously to approve the recommendation of the Shellfish Constable. Selectman Donovan suggested
that the Shellfish Constable examine whether shellfish grant license areas are being utilized.
The Board discussed:
Business Licenses on a motion by Parlante, seconded by May, the Board voted unanimously to approve the business licenses as printed on the agenda (Hannah and Co.; Two Girls with Good Taste; Bay Sails Marine; Yak Arts; Wellfleet Launch Service; Eric s Seafood Restaurant; Cove Gallery; Seaberry Surf Gift Shop; Idle Times Bike Shop, Inc.; The Eclectic Company; Glenn s Gallery; C.K. Smith & Co., Inc.; D & D Market; Harbor Luncheonette; Mac s Seafood Takeout; Mac s Seafood Market; Cape Cod Ocean Rafting). Selectman Houk noted that some businesses are operating prior to receiving approval of their licenses. Brewster Fox introduced Pat Gallardo and Wendy Johnson Salter, the principals of the new business Two Girls with Good Taste.

Requests to Use Town Property:
Big Man Run VII applicant Paul Colyer was in attendance and indicated that the group planned to confine adult beverages to the Beachcomber and would allow women to run in the event if it is requested. On a motion by Houk, seconded by May, the Board voted unanimously to approve the request of B.A. Event Promotions to use Ocean View Drive and Cahoon Hollow Road for the Big Man Run VII on June 8th from 2 p.m. to 4 p.m. on the condition that women be allowed to run in the event, that alcoholic beverages are not allowed on the beach and that participants are not allowed to run over sand dunes.
The Lighthouse Bob Derow was in attendance and indicated that this request was precipitated by a change of design for their septic system project. On a motion by May, seconded by Houk, the Board voted unanimously to approve the request of the Lighthouse Restaurant to continue the use of Town property as a staging area for equipment and components for a sewage disposal system installation through June 30, 2002.
Wellfleet Fire Relief Association on a motion by Donovan, seconded by Parlante, the Board voted unanimously to approve the request of the Wellfleet Fire Relief Association to use the Town Hall lawn and driveway on August 17, 2002 from 9 a.m. to 1 p.m. for a bake goods and t-shirt sale.
W.H.A.T. Theater on a motion by Parlante, seconded by May, the Board voted unanimously to approve the request of the Wellfleet Harbor Actors Theater to use the Baker s Field Tent on Saturdays, Sundays and Mondays from the week of July 6, 2002 through the week of August 19, 2002 from 4 p.m. to 10 p.m. for summer children s theater.
Luke Simpson (Cape Cod Ocean Rafting) Luke Simpson was in attendance and explained his request to use Town property to operate a scenic cruise business using a six passenger 22 foot inflatable boat. Selectman May disclosed that he works in the Harbormaster s Office. On a motion by May, seconded by Houk, the Board voted unanimously to approve the request of Luke Simpson to use the Town loading dock, for no more than 15 minutes at a time, to operate a scenic cruise business from Memorial Day through September from sunrise to 9 p.m.
Friends of the Dump on a motion by Parlante, seconded by May, the Board voted unanimously to approve the request of the Friends of the Dump to use the front of the Wellfleet Swap Shop at the dump on Saturday, May 25th from 8 a.m. to 3 p.m. for a garage sale to benefit the Eric Douglis Ecology Scholarship Fund .
Bookstore & Restaurant, Inc. Selectman Parlante recused himself and left the table. Caroline Parlante was in attendance and explained the need for a new well. On a motion by Donovan, seconded by May, the Board voted unanimously 4-0 to approve the request to use Town property at the end of the ballfield at Baker s Field for placing a well and running a water line for the months of May and June. Selectman Parlante rejoined the Board.
Restructuring of the Shellfish Department the Shellfish Constable outlined his proposal to staff the department with three full-time positions supplemented by seasonal employees. There was consensus to discuss this matter further after receipt of further information.
